Terms of sale

Article 1: Object of the contract
The genealogist is bound by an obligation of means and not of results, consequently, he undertakes to carry out the most complete research possible, according to the available archival documents, and in compliance with the legal texts. He will do everything in his power to obtain the expected results and his fees will be entirely due in the event of success as in the event of failure. Its fees can only be revised downwards in the event of a total absence of archival documents.

As part of genealogical research, the genealogist undertakes to search for any archival document attesting to the individual's parentage, in priority the parish and civil status documents of each ancestor of the said genealogy.

The results of his research will be the subject of a detailed report including the reproduction of the documents found, but also mentioning the documents consulted and any missing documents.

Article 2: Deadlines for completion
The completion deadline set in this contract may be revised depending on the exceptional and random closures of archive deposits; the difficulties encountered during the research; due to illness or accident of the genealogist, and more generally on the occasion of any other case of force majeure and fortuitous.

Article 3: Price and terms of payment
The amount of this contract may be revised downwards in the event of incomplete archives, in proportion to the research that cannot be carried out. All other additional costs generated by the service will remain the responsibility of the genealogist, except with the prior written consent of the client.

A deposit of 50% must be paid upon signature of the contract by the customer (or the full amount if the sum is less than 150 euros). The balance of the total amount of this contract is to be paid by check, or bank or postal transfer, or via Paypal upon receipt of the invoice. The price of Generalanille's services is not subject to VAT (art. 293B of the General Tax Code).

Any delay in payment automatically incurs interest at a rate equal to one and a half times the legal interest rate (law n ° 92-1442 of 31-12-1992). Late penalties are payable without a reminder being necessary.

Article 4: Modification of the contract
This contract may be modified at any time, at the request of one of the parties, with thirty days notice. If agreed, the modification will become effective upon signature by both parties of an amendment to this contract.

Article 5: Ownership of results
The genealogist enjoys a moral property “perpetual, inalienable and imprescriptible” on the genealogical file which he provides to his client, not on the archival documents which constitute the file.

The customer agrees not to use the verbatim results of this research for fraudulent or harmful purposes. He will take advice from the genealogist before any use other than private use.

Article 6: Confidentiality
The genealogist is bound by professional secrecy. In particular, he undertakes to respect the legal texts protecting the privacy of individuals. The parties undertake not to communicate, within the framework of this contract, confidential information on a third party and to act in good rights at all times.

Article 7: Liability for damage
Each of the contracting parties assumes, under the conditions of ordinary law, the responsibility for bodily injury, material or immaterial damage caused by its property or its processes to the personnel and property of the other party as well as to third parties.

Article 8: Duration of the contract
This contract takes effect upon signature by both parties and will remain in force until the completion of its purpose. Either party may, however, terminate this contract at any time, subject to thirty days notice. In which case the genealogist will not be required to reimburse the customer's provision if he has already started the research, subject of this contract. He will be entitled to demand additional payment, in proportion to the work already carried out.

Article 9: Obligations of the client
The client undertakes to communicate to the genealogist a reliable starting point allowing him to begin his research, to acknowledge receipt of the service and to pay the full amount fixed in this contract upon receipt of the fee bill.
